Privacy Policy.
How Bantu collects, uses, shares and protects personal information — including CVs and supporting documents — across Australia, Africa, and the UAE and wider Middle East.
About this policy
This policy explains how Bantu Recruitment Agency handles personal information collected through this website and through its recruitment services. It applies to candidates, to contacts at client employers, to referees, and to anyone who makes an enquiry through this site.
This policy is issued by Bantu Recruitment Agency, ABN 62 113 226 298. Bantu’s Australian head office is at 63 Burlington Street, Naval Base WA 6165, Western Australia. Bantu is registered in both Australia (Perth) and Zambia (Lusaka).
[TO BE CONFIRMED BY BANTU: the registered legal entity name, company registration number and registered office address of the Zambian entity, and the same details for any other country in which Bantu operates.]
Because Bantu operates across several regions, more than one privacy law can apply to the same person. Where those laws differ, Bantu aims to apply the standard that gives you the greater protection. This policy is written to sit alongside the Australian Privacy Principles under the Privacy Act 1988 (Cth), and alongside the rights given by the EU and UK General Data Protection Regulation where that regulation applies to you.
Information Bantu collects
Information you give Bantu. Your name and contact details; your CV or résumé and everything in it; work history, qualifications, training and professional memberships; referee details; your right to work and visa or residency status; salary expectations, notice period and availability; and anything else you choose to tell a consultant.
Information created during the recruitment process. Interview notes, assessment and test results, consultant records of conversations with you, notes of feedback from a client employer, and the outcome of an application.
Information from your use of this website. Pages visited and actions taken, the device and browser you use, and an approximate location derived from your IP address.
Information from other people. Referees and former employers; contacts at client employers; publicly available professional profiles and job boards; and screening or background-check providers where you have agreed to a check and it is permitted by law.
Sensitive information and identity documents
Some information needed for international placement is more sensitive than the rest — passport, national identity and visa documents; nationality and date of birth; health information where a role requires a medical assessment; and criminal history where a check is lawful and genuinely required for the role.
Bantu asks for this kind of information only where it is needed for a specific, identified purpose, and, where the law requires consent, only with your consent. Please do not send identity or medical documents until a consultant has asked you for them and told you which route to use. If a message asks for these documents early, out of the blue, treat it as suspicious and check our recruitment fraud guidance first.
[TO BE CONFIRMED BY BANTU: which categories of sensitive information Bantu actually collects, at which stage of the process, and how consent is captured and recorded in each region.]
Why Bantu uses your information
- To assess your suitability for roles and to put you forward to client employers.
- To contact you about roles, applications and enquiries.
- To carry out reference, qualification, right-to-work and, where required, background checks.
- To arrange interviews and to support the offer, onboarding and, where relevant, relocation process.
- To meet legal and regulatory obligations, including right-to-work and record-keeping requirements.
- To operate, secure and improve this website.
- To send you information you have asked to receive.
Lawful basis. Where the GDPR applies, Bantu relies on: taking steps at your request before entering into a contract; its legitimate interests in operating a recruitment business and matching candidates to roles; compliance with a legal obligation; and your consent, which you may withdraw at any time, for sensitive information and for marketing. Where Australian law applies, Bantu handles personal information in accordance with the Australian Privacy Principles, and collects sensitive information only with consent unless an exception applies.
Sharing your information
Client employers. The central purpose of a recruitment service is to present you to an employer. Bantu shares candidate information with client employers so they can assess you for a role, and tells you which employer it intends to approach.
[TO BE CONFIRMED BY BANTU: whether a candidate’s agreement is obtained before a CV is released to each named client employer, how that agreement is recorded, and what contractual obligations client employers accept in relation to candidate data.]
Service providers. Bantu uses third-party providers to run its website, email, applicant tracking and IT systems. Those providers may handle personal information only in order to provide those services to Bantu, and are not permitted to use it for their own purposes.
[TO BE CONFIRMED BY BANTU: the list of service providers and sub-processors that handle candidate data, and whether that list is to be published here or made available on request.]
Others. Referees you nominate; professional advisers; and regulators, law enforcement or courts where Bantu is required or permitted by law to disclose information. Bantu does not sell personal information.
International transfers
Bantu operates in Australia, Africa, and the UAE and wider Middle East, and international placement necessarily involves moving information between countries. If you apply for a role in a different country from the one you live in, your information will be transferred to that country and to the employer concerned.
The country receiving your information may not have privacy laws equivalent to those where you live. Where a transfer is made, Bantu seeks to put appropriate contractual protections in place and to require the recipient to handle your information consistently with this policy.
[TO BE CONFIRMED BY BANTU: the countries to which candidate data is transferred, where Bantu’s systems and records are hosted, and the transfer safeguards relied on — for example standard contractual clauses or equivalent contractual protections.]
How long information is kept
Bantu keeps personal information for as long as it is needed for the purpose it was collected, and for as long as legal and record-keeping obligations require. After that it is deleted or de-identified. If you ask Bantu to stop considering you for roles, your record can be closed and removed, subject to any records Bantu is legally required to keep.
[TO BE CONFIRMED BY BANTU: retention periods for active candidate records, unsuccessful applicants, placed candidates, client records and general website enquiries, in each region.]
Keeping information secure
Bantu takes reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. No website, email system or database is completely secure, and information sent to Bantu over the internet is sent at your own risk. Please use the application and upload routes published on this website rather than sending sensitive documents to an unverified address.
[TO BE CONFIRMED BY BANTU: the technical and organisational security measures Bantu wishes to describe here, and the process for assessing and notifying an eligible data breach under the applicable schemes.]
Your rights over your information.
The rights available to you depend on where you live and which law applies. Bantu will not treat you differently, or withdraw you from consideration for a role, because you have exercised a right.
Access and correction
You can ask what personal information Bantu holds about you and ask for a copy of it, and you can ask Bantu to correct anything that is inaccurate, out of date or incomplete.
Erasure and restriction
You can ask Bantu to delete your information, to stop using it, or to stop considering you for roles. You can withdraw consent at any time, and you can object to processing based on legitimate interests. Where the GDPR applies you may also ask for your information in a portable form.
Complaints
You can complain to Bantu about how your information has been handled, and Bantu will investigate and respond. If you are not satisfied, you can complain to the privacy regulator where you live — in Australia, the Office of the Australian Information Commissioner.
How to make a request. Contact Bantu using the details in the Contact section below. Bantu may need to confirm your identity before acting, so that information is not disclosed to the wrong person, and will respond within the period required by the law that applies to you.
[TO BE CONFIRMED BY BANTU: the response times Bantu commits to for access, correction and erasure requests, and the supervisory authorities to name for Bantu’s African and Middle East markets.]
Cookies and website analytics
This website uses cookies and similar technologies. Some are necessary for the site to work. Others help Bantu understand how the site is used so it can be improved. Most browsers let you refuse or delete cookies through their settings; refusing some cookies may affect how parts of the site behave.
[TO BE CONFIRMED BY BANTU: which cookies, analytics tools and marketing or advertising technologies are in use on the live site, what each is used for, how long they persist, and whether a consent banner is required for visitors in the EU, the UK or elsewhere.]
Marketing and updates
Bantu will send you market updates, vacancy alerts or similar material only where you have asked to receive them or where doing so is permitted by the law that applies to you. Every message will include a way to unsubscribe, and you can ask to be removed at any time by contacting Bantu directly.
Children
This website and Bantu’s services are intended for people who are of working age in their own country. Bantu does not knowingly collect information from children. If you believe a child has provided personal information to Bantu, please contact us so it can be removed.
Changes to this policy
Bantu may update this policy as its services, systems or legal obligations change. The current version is always the one published on this page, and the effective date is shown below. Where a change materially affects how your information is used, Bantu will take reasonable steps to bring it to your attention.
